Forest River Wins Trademark Infringement Lawsuit

Forest River won a jury trial decision favoring its East to West brand over inTech RV in a trademark infringement lawsuit.

The jury verdict declared inTech RV willfully infringed on East to West’s Della Terra and mountain design trademarks. The jury awarded Forest River millions of dollars in damages.

Forest River said the jury deliberated less than three hours before coming to its verdict.

Forest River’s East to West division has sold Della Terra travel trailers since 2018. The travel trailer brand features a trademarked signature mountain design.

The dispute involved inTech’s Terra travel trailer. Because Forest River said the Terra bore a similar mountain design to Della Terra’s, Forest River issued inTech a cease-and-desist notice.

The demand claimed inTech violated Forest River’s trademarks under federal and state trademark law. In September 2023, the court determined Forest River owned a protectable interest in its Della Terra and mountain design trademarks, rejecting inTech’s claim of priority over Terra.
